A western Sydney man’s Holden Commodore was searched by police officers to make sure he had no weapons, as he was subject to a firearms prohibition order. Instead of a gun, police discovered a number of resealable bags containing ‘ice’.

Daniel Tanner, 27, appeared before Penrith Local Court on March 10 where he pleaded guilty to possessing a prohibited drug.

Court documents reveal about 8.30pm on October 29, police drove past a white Holden Commodore on Glebe Place, Penrith and, after conducting checks, realised Tanner was subject to a current firearm prohibitions order.

Police returned to the area and saw the car on Copeland St turning left onto Parker St, Penrith. They activated their warning lights and pulled the car over on High St finding Tanner in the driver‘s seat with a friend in the passenger seat.

Police searched Tanner’s car and found a number of items of interest, including a backpack with a set of scales in a fabric case with small resealable plastic bags which held a white crystalline substance police alleged was methamphetamine. Three mobile phones were also found in the backpack.

According to the police facts, Tanner told the police he owned the backpack but denied knowing about the drugs while his friend denied knowing anything.

The story later changed when police spoke with the men separately and it was agreed they’d found ice earlier at a Derby St park.

The drugs weighed 6.39g

Magistrate Stephen Corry addressed Tanner’s history when handing down his sentence.

“The sentencing assessment report indicates that drugs are a continued part of your offending. You’ve tried to address that since your release,” he said. “ Taking those matters into account, you would benefit from supervision to ensure you don‘t relapse.”

Tanner was convicted and sentenced to a 12 month community correction order for a period commencing in March 2022.
