A western Sydney father has appeared in court after allegedly choking and raping a woman.

A 23-year-old father has appeared in court after allegedly choking and raping a woman.

Brayden Albrecht, of Watanobbi, applied for bail at Penrith Local Court on February 4 after he was charged with choking a woman and having sexual intercourse without consent in November last year.

“Visible marks could be seen on the victim's neck and his DNA was on her,” the police prosecutor said.

Albrecht’s lawyer Naomi Steinberg said the father of two had a limited criminal history, was now based in Wyong and could report to police as frequently as possible, if granted bail.

The police prosecutor said there was a risk Albrecht would disobey court orders as he had done on a previous occasion and there was an unacceptable risk to the community if he was granted bail.

Magistrate Stephen Corry refused the application for bail, noting Albrecht’s history of violence.

“There is a strong prosecution case as there is not just the victim’s statement and injuries but there are witness statements,” he said.

The matter will return to court later this month.
