A sex worker illegally recorded a naked client in the shower and at the start of their encounter due to her fears for her safety, a court has heard.

The 26-year-old pleaded guilty to intentionally recording an intimate image of another person without their consent and faced Parramatta Local Court on Tuesday (April 11).

Facts reveal the North Richmond woman had been working at a Parramatta brothel for three months when a man entered the club at about 9pm on December 12 last year to engage in sex.

After inspecting the man, a routine practice done to ensure the sex worker agrees to offer their services, the woman requested the victim showered.

The sex worker positioned a phone on a bedside table so the victim was in frame.

The court heard the woman started recording the man - who she believed may have been a previous client - due to her concern for her safety.

The woman told police she started filming due to safety concerns.

The recording captured the man‘s naked buttocks.

The pair started kissing and becoming physically intimate on the bed when the victim noticed the phone and asked the woman to stop.

She initially claimed she was unaware the phone was recording, before the victim took the phone and informed the venue manager.

Police then attended the venue and discovered the recordings of multiple unidentified men on the woman’s phone.

The court heard the sex worker had no criminal record and suffers from anxiety and depression but had learned from her mistake.

“It’s not something she would do again, she’d walk away from the situation,” the sex worker’s lawyer said.

Magistrate Kate Thompson said the woman was remorseful and understood the laws surrounding recording someone without consent.

“She had concerns about the person she was engaged in an intimate act with,” Mr Thompson said.

Ms Thompson acknowledged the footage did not go anywhere and was deleted by police.

“There is no ongoing harm, however people are entitled to engage in intimate acts without being filmed,” she said.

The woman was not convicted but will serve a 12 month conditional release order requiring her to be of good behaviour.
