Samisoni Mafuadaimi hit partner in domestic violence assault

A man who stood on his partner’s head before repeatedly kicking it after she discovered he was cheating on her has been told “the days of assaulting women are over’’ when he faced court for sentencing.

Guildford tradie Samisoni Mafuadaimi will enjoy freedom on his 40th birthday after being spared a jail sentence for assaulting his former defacto partner and inflicting a large lump on her head when she confronted him about cheating.

At Parramatta Local Court on Wednesday, Mufuadaimi was sentenced for the brutal attack on December 15 when he returned to the granny flat he shared with his partner of three years after a drunken night at the Guildford Hotel despite her pleading with him through text messages not to come home or she would call the police.

Court papers revealed the formworker, who turns 40 on Sunday, jumped a side gate and opened an unlocked window before entering the flat where he crashed on the bed.

The victim then saw text messages to another woman on his phone and woke him up, setting him off on a violent rampage.

He pulled her to the ground by her hair with both hands and while she lay down, punched her to the back of the head.

“The victim had her hands up trying to protect herself and it is unknown whether one or both hands were used,’’ police facts tendered to the court said.

“This has caused a large lump to the rear of the victim’s head and pain as a result.”

But Mafuadaimi continued the torrid abuse and stood on her head before kicking it three times, causing the victim swelling to the right jaw and cheek region and a cut to the inside of her mouth.

The victim fled to the Guildford Hotel, where she called her friend to drive her to Merrylands police station where she reported the crime and eight photos of her injuries were taken.

When cops arrested Mafuadaimi at his home about 4am, he was so intoxicated he needed a time out and was charged with assault occasioning actual bodily harm (domestic violence related).

He pleaded guilty when he appeared for sentencing before Magistrate Robyn Denes this week.

Through a Tongan interpreter, Ms Denes told the court his actions normally led to imprisonment.

She acknowledged he was respected in his community and a hard worker but “the days of assaulting women are over’’.

“She’s accusing you of being disrespectful to her by seeing other women. You abused her as if she’s done something wrong. She didn’t like you drinking and you disrespected her views on that. There’s an old saying ‘You can’t have your cake and eat it too’. You were trying to have it both ways, and when you got found out and she had enough, you bashed her.’’

Ms Denes imposed an 18-month intensive correction order on Mafuadaimi, who has to comply with an AVO and complete 120 hours of community service work.
