Guildford: Group who allegedly kidnapped and bashed man in court

A group of men who allegedly kidnapped and bashed a man, forced him into a BMW and threatened him with a sword after telling him to ‘denounce’ his marriage have had their matters heard in court.

The group of men who allegedly kidnapped and bashed a man at Guildford will remain behind bars on remand for at least another two months in NSW after trying to “end the relationship” between him and his wife.

Kodar Faytrouni, 27, Safwan Hussein, 40, Abud Elkerdi, 36, and Ali Hamad, 33, allegedly travelled from Victoria to the Guildford Rd apartment of a 25-year-old man on Wednesday.

A police source said it would be alleged the Guildford man had been told to “denounce” his marriage because his in-laws did not approve of the union.

Just before 10am, the men were accused of forcing their way into the home before allegedly assaulting and choking the man and forcing him into their BMW sedan.

Witnesses reported it to Cumberland police, who, along with the Serious Crime and Raptor Squad, deployed a large scale investigation and search for the car.

The man was allegedly driven to another property at Constance St, Guildford, where it will be alleged the group continued to bash and threaten with a sword.

Several hours later, police allege the man was forced back into the BMW which shortly after was spotted by investigators who stopped the car near Chetwynd Rd.

Mr Hamad, the front seat passenger from Hoppers Crossing in Melbourne, allegedly fled the vehicle but was arrested shortly after.

The other BMW occupants including 40-year-old driver Mr Hussein and two passengers aged 27 and 36, were arrested at the scene.

The BMW was seized for forensic examination.

Police allege the group travelled from Victoria to threaten and assault the 25-year-old man who is known to them. Court documents allege the men had the intention of “ending the relationship” between the alleged victim and his wife.

Each man was charged with take and detain person in company with intent to obtain advantage, and aggravated break and enter and commit serious indictable offence – use violence.

At Parramatta Local Court on Thursday, Faytrouni’s lawyer applied for her client to be released on bail after the court heard how the Merrylands resident had mental health impairments.

The court heard how the courier driver allegedly made threats to kill the complainant and how the alleged incident arose over a misunderstanding.

The prosecution opposed bail, telling the court there were concerns over Mr Faytrouni endangering the alleged victim’s safety and despite his record not being lengthy he had a history of violence.

“The offences are extremely serious,’’ prosecutor Rebekah Jung said.

The father has family in Victoria and an application for home detention would have seen him live with his sister at South Wentworthville.

The court also heard how he had an extensive history of trauma and had a head injury when he was younger that led to PTSD and he has also been diagnosed with ADHD.

He requires valium and he was finding it “difficult” in custody over the past 24 hours without access to medication.

Magistrate Kate Thompson refused bail, noting there were concerns about interfering with witnesses and an unacceptable risk to the community.

On Friday, Mr Elkerdi, from Hoppers Crossing, was also refused bail.

His barrister, Evan James, told the court Mr Elkerdi did not have a lead role to play in the alleged offence and that CCTV showed that he “acted on instruction” from the principal.

The court heard how the complainant’s injuries were not consistent with the allegations, and included scratches and bruises.

Mr James said the 36-year-old suffered from diabetes, heart problems, depression and anxiety, which required medication, but Magistrate Kate Thompson said Justice Health could treat that in prison.

She rejected the proposal to release Mr Elkerdi on home detention and cited multiple other reasons for not granting bail, including the fact he lives in Victoria making the risk of failing to appear in court a concern.

Ms Thompson said Mr Elkerdi’s potential to interfere with witnesses was also concerning.

Mr Hamad and Mr Hussein’s matters were not heard on Friday and adjourned to March 9.
