NSW food fines proposed to increase 125 per cent as new report lays bare hygiene, safety stats

A hefty increase in food safety fines is being considered for NSW eateries as part of plans to reign in the number of restaurants and other food-related businesses caught breaching safety and hygiene standards.

The NSW food regulator has released plans to more than double the value of current food safety fines from $880 to $1980 in a bid to boost compliance rates in the industry.

The current $880 fine has previously faced criticism for failing to act as a strong enough deterrent for breaches of NSW Food Regulations.

It is the maximum infringement that can be imposed for breaches on businesses during compliance checks, which are undertaken by councils.

The proposed increases for inspection and audit fees would re-calibrate fees to account for the current economy and help councils to recover their costs of regulating food premises more adequately.

NSW Local Government Association president Darriea Turley said the proposed fine increase would help councils recover costs from regulating food premises.

The NSW Food Authority is also proposing to increase fines for contravening a prohibition order which would increase from $770 to $1100 for an individual, and from $1540 to $2200 for a corporation.

The proposed increase comes as the NSW Food Authority annual report shows 908 food safety and hygiene breaches penalty notices were issued to businesses last financial year – up from 550 just two years ago.

The most common offence detected was “unclean food premises” (accounting for 19 per cent of fines), followed by “improper food storage” (16 per cent of fines), “poor handwashing facilities” (12 per cent of fines), “unclean fixtures and fittings and equipment” (9 per cent of fines) and “poor pest control” (7 per cent of fines).

The NSW Food Authority stated the proposed increase in fines was aimed at ensuring food is “fit for sale” and to deter businesses from committing food safety offences.

Since July 1, a public register of food fines showed a total of 180 penalties have been issued to businesses including supermarkets, sushi venues, and fast food restaurants.

The list shows some venues were hit with multiple fines during inspections including the Harvest Foodie restaurant in Burwood which received seven penalty notices.

This was followed by Jiang’s Yunan Rice Noodle in Burwood and the Woolworths outlet in Bondi which each received six fines.
