A father-of-three accused of importing almost 3kg of MDMA to his family home in Sydney’s north west was granted bail in court on Tuesday.
David Burge, 42, from Carlingford was arrested yesterday after being charged with seven drug offences including importing and supplying MDMA, supplying 14g of the drug ice, and recklessly dealing with proceeds of crime amounting to $1370, according to court documents.
On Monday, police executed a search warrant at his Jenkins Rd property where they allegedly seized 2.7kg of MDMA, as well as quantities of ice and cannabis.
Police facts tendered in court reveal he had also allegedly imported MDMA to his Carlingford home on February 16 and 25.
In court, Mr Burge appeared via AVL and sat quietly donning a white singlet during his application for bail.
Police prosecutor Reuben Vanderbyl told the court he opposed bail saying there was a “strong prosecution case” and police had seized a number of items.
He told the court Mr Burge had prior convictions for supplying drugs in his record and had used his home address when operating his alleged drug business.
“These offences involved the use of the defendant's home…It’s my submission that any bail conditions are placed on his home address... his home is also where he conducted his business allegedly,” Prosecutor Vanderbyl told the court.
Mr Burge’s legal aid representative told the court he was a landscaper earning $1800-1900 a week and a father of three young kids who had “strong family connections.”
He told the court that Mr Burge had not been in court since 2012 and would offer $3000 surety if bail was to be granted.
Magistrate Tim Keady told the court Mr Burge was charged with “serious offences” and said the most serious was the importation of prohibited drugs including two consignments of MDMA addressed to his Carlingford home.
He told the court quantities of the drugs were “significant” and that ice and cannabis were also seized after a police search.
“Taking into consideration the facts as I’m required to my assessment of the case is it’s a strong one,” Magistrate Keady told the court.
When handing down his determination of bail, the magistrate noted he had three children and his last recorded conviction was in 2012.
Magistrate Keady approved bail with strict conditions including a curfew requiring him to not leave his home from 5am-5pm and to report each day to Eastwood police.
He was also told he could not move addresses, not allowed to travel internationally and to pay a $3000 surety.
The matter has been adjourned to May 8 for a full brief of evidence to be served.
