Stephen Barrie Moore jailed at Forster court for Tuncurry assault

A Mid-North Coast man with an appalling criminal history has been jailed with the magistrate dismissing a “poisoned pen” letter tendered in court. See what happened when he was taken away.

A man with an appalling criminal history has been jailed after pelting a full beer can into the back of a woman’s head at Tuncurry with the magistrate dismissing a “poisoned pen” letter submitted to the court.

Stephen Barrie Moore was sentenced for assault occasioning actual bodily harm by magistrate Allison Hawkins at Forster Local Court on Wednesday.

The 46-year-old Taree man will be first eligible for parole on June 24 next year.

Ms Hawkins said a “poisoned pen” letter submitted to the court designed to paint the victim as “the devil incarnate” did Moore no favours and showed a lack of insight into the offending.

The court heard Moore, who was on bail at the time and has an “appalling” criminal history, threw a full can of beer at the back of a woman’s head after he ordered her out of the Tuncurry unit where they had been drinking on the afternoon of February 4.

The can hit her hard, causing her to fall down some stairs and a witness called triple-0.

Documents submitted to court show Moore has a history dating back to the mid-90s with convictions for drink driving, resisting and assaulting police and a number of serious domestic violence matters.

As he was led into custody the woman who had accompanied him to court stormed out, saying “why don’t you send people to jail who deserve it”.
