Kai McNally appeared in Taree Local Court on Wednesday February 22 via audio visual link and pleaded guilty to using a carriage service to procure a person under the age of 16 years for sexual activity.

The charge relates to conduct carried out between January 1 and July 22 last year in the Bulahdelah area.

The 26-year-old has been remanded in custody ever since his arrest on the evening of July 22 last year when he attempted to meet up with the boy at a park in Coolongolook - a small village on the Pacific Highway between Bulahdelah and Nabiac.

Prior to his arrest he lived along Markwell Road in the Upper Myall, west of Coolongolook.

McNally sat calmly during the court proceedings in black rimmed glasses with his face clean shaven and light brown hair cut short.

According to facts tendered to court McNally sent the boy, who was 12 at the time, a tirade of messages mostly via Snapchat asking him to send intimate videos in return for money and items including vapes.

McNally’s messages ranged from professions of love to threats:

‘I love you monkey.’

‘Loving you shouldn’t be this hard.’

‘Keep treating me like shit and I will learn not to love you.’

‘I just want to talk to you and see you. I just want you.’

‘I’m here (at the park) third time, you haven’t showed up. Do I just stop?’

‘I wish you could tell me you’re not coming so I can stop showing up here every Friday.’

McNally also urged the boy to send him intimate videos:

‘And they have to be the best vids btw - they ain’t cheap...otherwise you don’t get all, only half’

‘For the vids I have to be able to save them and I want, like, the whole thing’.

The maximum penalty for using a carriage service to procure a person under the age of 16 years for sexual activity is 15 years prison. The matter was adjourned for sentencing in the district court on April 24.

McNally is also facing 16 other charges relating to drug supply, weapons, firearms and ammunition and these have been adjourned in the local court to February 28.
