A Taree magistrate gave police officers “next door” a severe dressing down for delays in an aggravated robbery and assault case.
Aidan James Ellison appeared before Magistrate Allison Hawkins at Taree Local Court on Monday charged with aggravated robbery, driving with a low range concentration of alcohol, drive with a suspended licence and assault occasioning actual bodily harm.
The offences were alleged to have occurred on June 4 this year and Ellison is yet to enter a formal plea.
Ellison was remanded in custody for several months after his arrest on June 6 but was released on bail in early November.
The aggravated robbery is alleged to have taken place between 10.15 and 10.30pm on June 4 and involved two alleged victims – a man and a woman.
The 31-year-old is alleged to have stolen property including a mobile phone, cordless drill and medication.
It is further alleged that immediately prior to the alleged robbery he inflicted actual bodily harm to the man.
The assault occasioning actual bodily harm charge is in relation to a third alleged victim during the same time frame, also at Taree.
Ms Hawkins told the court she was “ready to deal with this matter right now” but there was no charge certificate ready to be presented to the court.
A charge certificate outlines the offences the prosecutor intends to proceed with.
A lawyer working for the Director of Public Prosecutions in an adjoining courtroom was called in to shed some light on the matter but he told the court he had “no idea” where the charge certificate was up to and he wasn’t sure who was responsible in this particular matter.
“I talk and talk and talk about the police force’s inability to serve briefs on time,” Ms Hawkins said.
“If you are looking for someone to blame – look next door to the police station. I am tired of the delays, I expect better.”
When the matter returned to court in the afternoon it was adjourned for a case conference on February 8, 2023 and Ellison’s bail was continued.
