Savannah Daisley seeks bail variation

A DPP solicitor has said an “erotic” dancing video captured before a Sydney wellness entrepreneur allegedly sexually assaulted a teenage boy is being downloaded from a phone as evidence in their case.

A Sydney wellness entrepreneur charged with sexually assaulting a teenage boy was allegedly captured dancing in an “erotic” video before the offences are said to have occurred, a court has heard.

Smart Cleanse founder Savannah Daisley, 45, was charged in June 2022 with four counts of aggravated sexual intercourse without consent with a 14-year-old boy.

Her solicitor has previously told the court she denies the allegations and intends to fight the charges.

A court has previously heard Daisley allegedly had sex with the complainant four times over a 23-hour period in May 2021.

The DPP has now indicated in court a mobile phone video of Daisley dancing in what they say is an “erotic” fashion is being sought by them as prosecution evidence ahead of her trial.

Daisley’s solicitor Michael Hempsall told the court it would be submitted the alleged video, said to have been shot shortly before the alleged assaults occurred, would “speak for itself”.

“There are some fancy dress costumes, some Michael Jackson moonwalking and some breakdancing,” Mr Hempsall said. “That’s normal and not controversial.”

The new details emerged as Mr Hempsall brought an application to vary Daisley’s bail before Magistrate Margaret Quinn at Downing Centre Local Court.

Mr Hempsall said the conditions, to which Daisley has been subject since her release on bail on September 19 with a $100,000 surety submitted by her parents, were akin to house arrest.

Daisley became overwhelmed with emotion, wiping tears from her eyes as her solicitor spoke to some of the more personal consequences of her strict bail conditions, which cannot be reported in further detail.

Multiple new aspects of the allegations against Daisley were raised in court, though many cannot be reported on for legal reasons.

Director of Public Prosecutions solicitor Rebecca Nezval said she would consent to several amendments to Daisley’s existing bail, including an adjustment to a curfew.

Ms Quinn ultimately granted the application, based on submissions made about the interests of justice.

Daisley will face Downing Centre Local Court again on December 22 where it is expected her matter will be committed for trial at Sydney District Court.
