A man has pleaded not guilty to intentionally throwing a shopping trolley with a mate in it, into a group of cyclists who were going for an early morning ride.
Jack Maartensz, 26, of Mona Vale appeared at Manly Local Court on July 10 over a raft of charges related to the incident which happened between 5.40am and 5.46am on March 7 outside a Caltex service station in Dee Why.
While he’s pleaded guilty to two counts of assault occasioning actual bodily harm and two counts of intentionally or recklessly destroy or damage property, he’s pleaded not guilty to intentionally throw object at vehicle.
He also managed to get two charges of common assault dropped during negotiations, with a hearing date set for September 22.
The cyclists were travelling at 40km/h along Pittwater Rd when the trolley came out of no where and crashed into them, causing injuries to two riders who fell off their bikes and damage to the bicycles.
According to documents tendered in court, one of the damaged bicycles was a “Scott Addict” valued at $3000.
Court papers also named the affected cyclists as Peter Moore and Radek Valenta.
In court documents labelled reason for bail decision by police officer it’s alleged “the offence is serious due to the act the accused has committed by pushing a trolley with another adult male into a group of bicycle riders travelling at speed”.
According to the same document, police allege there is evidence including CCTV “clearly showing the offences committed by the accused”.
Maartensz remains on bail with a for three-hour hearing date has been set for September 22.
