A man who will stand trial over the alleged hit and run death of actor Bardiya McKinnon has been caught behind the wheel in breach of his bail.

Anthony Kerry Bain, 50, was allegedly driving a Ford Ranger ute on November 21 last year in North Sydney when it collided with a motorcycle ridden by 28-year-old McKinnon.

The actor, who regularly appeared in theatre productions across Sydney and featured in TV shows on the Disney Channel and SBS, skidded some 32 metres along the roadway, and died in hospital two days later.

Police allege Bain, of Elanora Heights, drove away without calling triple-0 or offering assistance to McKinnon.

Bain previously told a court he heard a noise but was not aware he had allegedly collided with a motorcycle.

He is charged with dangerous driving occasioning death (drive in a manner that is dangerous), fail to stop and assist vehicle impact causing death and negligent driving occasioning death, as well as a backup charge of not giving particulars to police.

He has been on bail since early 2021 after his release was granted by the Supreme Court.

However, his bail was revoked over the weekend after police discovered him driving through Glebe on Saturday night.

Part of his bail conditions state he cannot drive or occupy the driver’s seat of a motor vehicle.

On Saturday October 23 he was pulled over by police for a random breath test, where his bail conditions were confirmed through a routine test.

Bain has entered pleas of not guilty to the charges and his matter is listed for a trial on August 15 next year.

The matter will next be before the Sydney District Court for a readiness hearing on June 10.
