A 23-year-old man has been hospitalised after he allegedly took a roundabout at high speed and flipped his car several times in a horrific crash that killed his brother in south-west Sydney.

Ahmed Mubashir was due to appear in Moss Vale Court on Monday after he was charged with driving more than 45km over the speed limit, driving at a dangerous speed occasioning death, driving in a dangerous manner occasioning death, and negligent driving occasioning death.

Police will allege the Victorian resident was driving a grey Toyota RAV4 at more than 45 km/hr over the signposted speed on Picton Road in Picton at 4.45am on Sunday morning when he allegedly clipped the side of the roundabout near Maldon Bridge Road.

Police allege the car flipped several times and landed in a nearby creek. Police allege Mr Mubashir’s brother, who was the passenger in the car, was decapitated upon impact and his body was thrown for more than 40 metres from the vehicle.

According to police allegations, the passenger died at the scene. Mr Mubashir was treated at the scene and taken to Liverpool Hospital to treat his injuries and for mandatory testing.

Moss Vale Court heard Mr Mubashir was unable to attend court because he is still being treated at Liverpool Hospital for injuries sustained in the horrific crash.

The court heard he has been refused bail for the alleged offences. His lawyer told the court he was hired by Mr Mubashir’s sister only half an hour before the court appearance, and requested an adjournment.

Mr Mubashir will return to Moss Vale court on May 31.
