Joshua Gibbs breaches community corrections order throwing Vegemite at his mum

A 25-year-old father has been sent to jail after throwing a jar of Vegemite at his mother and threatening to stab her while on a corrections order for ramming his ute into an ex-girlfriend’s car.

A 25-year-old father was sentenced to prison for threatening his mother and throwing a jar of Vegemite at her while on a community corrections order.

Joshua Gibbs appeared before Campbelltown District Court on Friday to appeal his 12-month prison sentence handed to him by a magistrate in the local court last month.

He ended up behind bars for threatening to stab his mother and throwing the condiment at her while serving a prison sentence by the way of community corrections order in November, breaching his conditions.

The 25-year-old Ingleburn man first appeared in court in September after following his former partner and driving at her in his blue Holden Ute during a heated argument in April last year, causing a collision.

Court documents reveal the offence occurred throughout several residential streets and the young father was subsequently charged with driving a motor vehicle with intent to menace another and driving while disqualified.

Gibbs was later charged with stalking or intimidating to cause fear or physical or mental harm when he sent a spate of threatening messages via Facebook Messenger to the same woman in July.

Despite being separated for a year and sharing a two-year-old child, the 25-year-old sent 190 messages under the account “Peter Parker” to the woman on July 10 between 12am and 3.21am, according to court documents.

Some of the messages read “It’s your call, I’m going to kill you though”, “I’m going to bash the living s**t out of you”, “You’re not safe until I’m dead”, and “I swear on all your kids I’ll end my life if you don’t reply in the next five minutes”.

The woman took the messages to police the following day and received more messages from Gibbs saying he lost his phone and had only just woken up “in an attempt to remove himself from the incident”, court documents state.

When officers arrived at his home to arrest him, he pretended to be asleep to avoid having to deal with the matter, the court heard.

Gibbs was arrested in September and sentenced to a community corrections order in the local court.

Just two months after his charges, the young father was arrested following another domestic violence attack on his mother, who he was living with.

On November 11 last year, Gibbs’s mother had been sitting at home listening to music when her enraged son came in and smashed the glass stovetop in the kitchen.

Gibbs then picked up a jar of Vegemite and threw it towards his mother, before it hit a wall and smashed, according to court documents.

He then threw utensils around the kitchen and told his mother “I’m going to stab you and your mother” when she attempted to leave.

When police arrived, Gibbs refused to calm down and listen to police instructions, and put his teeth around a female officer’s wrist.

He was charged with intentionally or recklessly destroying/damaging property, common assault, stalk or intimidate to cause fear of physical or mental harm and assaulting a police officer.

A result of the charges meant he had breached his community corrections order and was sentenced in the local court last month to one year behind bars with a non-parole period of six months.

Gibbs appealed his sentence in the district court on Friday with Judge Julia Baly revealing the 25-year-old had a “long history of drug and alcohol abuse”.

In reviewing the matter, Judge Baly said the assault charge on his mother was “serious” and he has a criminal history of similar offending.

“I accept he has mental health issues and issues with aggression but he has not addressed those issues and continues to reoffend,” she told the court.

“My view is the magistrate took a somewhat lenient approach in the prison sentence and a generous non-parole of six months.”

Judge Baly said there was “no ground” to intervene with the sentence and dismissed the appeal.
