Emilia Komin pleads not guilty to intimidation, Raymartin Faileaso pleads guilty to break and enter at Moss Vale

A woman (pictured ) allegedly posted slanderous messages in Chihuahua-related social media groups. Weeks after this, the woman who was allegedly a target of these posts opened her front door to find a man with “links to organised crime” demanding she return a dog, court documents reveal.

An alleged argument over a prized stud Chihuahua called Milo saw a man with “links to organised crime” invade a woman’s home.

Raymartin Faileaso, 30, fronted Moss Vale Local Court on Monday where he pleaded guilty to aggravated break and enter to commit a serious indictable offence and stalk and intimidate to cause fear of physical harm.

Emilia Aleksandra Komin, 39, who was also charged over the matter, has denied her involvement and any wrongdoing.

She has pleaded not guilty to two counts of stalking and intimidation, accessory after an aggravated break and enter, and concealing a serious indictable offence.

Faileaso - who court documents also state is “heavily involved in organised crime” - invaded a Moss Vale woman’s home after an alleged argument about a prized Chihuahua.

At the end of 2020, court documents stated the woman began communicating with Emilia Komin, whom she met on a Chihuahua Facebook page.

The woman and Komin began speaking over Messenger, and a deal was allegedly struck for the woman to borrow a stud Chihuahua by the name of Milo to breed.

The facts tendered in court state the alleged agreement was the woman would pay $600, and the stud would stay at her home address in Moss Vale for two weeks.

In late 2021, Komin allegedly offered to sell the woman her stud for $2000 with a $500 deposit and the balance to be paid after Christmas.

The woman transferred $200; however, the remaining $300 was to be paid by the woman’s boyfriend.

According to court documents, the woman offered to have a contract drawn up, but Ms Komin allegedly said it was unnecessary.

The woman collected the stud but was notified the $300 had bounced the following day.

On November 22, the woman was at home when Komin allegedly came over with another woman and demanded the dog back.

The woman said she would pay the other $300 in cash or return the dog if the original $200 was returned.

Police were contacted, and the women left.

Following this, court documents state Ms Komin allegedly posted in several Chihuahua-related social media groups slandering the woman.

On January 28, 2022, the woman’s female Chihuahua had five puppies, and a couple of months later, she advertised them for sale under a different name.

The same day, Ms Komin allegedly tried to contact her, but the woman did not answer.

On March 30, the woman was at home when she heard a knock.

When she opened the door, Faileaso stood there and said, “where’s my mate’s dog?” and the woman replied, “sorry?”.

Faileaso said, “don’t act f--king dumb. Where’s the dog”.

After some back and forth, the woman closed the door and walked away but heard kicking and saw Faileaso coming through the front door yelling, “where’s the f--king dog”.

The woman tried to block Faileaso from entering the kitchen. He walked up to the woman and threw her to the ground.

Faileaso walked up to another person in the house, clenched his fist in their face and said, “don’t call the f--king police,” and continued to yell, “where’s the f--king dog”.

The court documents further state when he was told the dog was not there, Faileaso checked the backyard before warning the victim to have it back in a week or “I’ll come back and kill you”.

Police later charged both Ms Komin and Faileaso. Ms Komin denies any wrongdoing and pleaded not guilty to all charges against her.

Faileaso will be sentenced at Goulburn District Court, and his matter will next be mentioned there in May.

Ms Komin will face trial, and an arraignment has been set down in May at Goulburn District Court.
