Dismissed: Indecent assault charges withdrawn against teacher
A Catholic primary school teacher accused of indecently assaulting a 13-year-old girl in his Year 6 classroom has had the two charges withdrawn at Liverpool Local Court this morning.
The charges against a Catholic primary school teacher, accused of indecently assaulting a 12-year-old girl in his Year 6 classroom, have been withdrawn and dismissed at Liverpool Local Court.
James William Hayes, 29, was charged last September with two counts of indecently assaulting a child under 16 after a report had been made to the State Crime Command’s Child Abuse Squad in May.
The Director of Public Prosecutions this morning withdrew the two charges at Liverpool Local Court. Four days had been scheduled for a hearing.
The dropped charges related to an alleged incident at St Justin’s Catholic Primary School in Oran Park in 2017.
The Cobbitty man was charged in September last year after several months of investigation. He pleaded not guilty to the charges last September at Liverpool Local Court.
He was teaching at St Gregory’s College Junior School at the time of his arrest.
Mr Hayes, who sat in the back corner of the courtroom with his parents, indicated he will seek costs.
The application for costs was opposed by the prosecution, with a hearing scheduled for Liverpool Local Court on August 16.
