Ashur Durbidge: Ex-Bandidos bikie makes second bail bid over alleged fight with gang member

A former Bandidos bikie – who told the court he has severed all ties with the gang since he was charged – has made a second bail bid over allegations he had a punch-on with another gang member.

A former Bandidos bikie – who told the court he has severed all ties with the gang since he was charged – has made a second bail bid over allegations he had a punch-on with another gang member.

Ashur Durbidge, 22, was arrested on August 8 and was refused bail in Downing Centre Local Court on August 16 but successfully applied for release in the Supreme Court on August 28.

The court heard he needed to be at liberty because his girlfriend was going through IVF treatment.

High profile lawyer Ahmed Dib told the court Durbidge had cut all ties with the Bandidos, which Justice Hament Dhanji accepted before he granted bail on a number of conditions.

Durbidge must live at his home in the Narellan area; report to Narellan police daily; comply with a night time curfew unless in the company of his girlfriend, to report to police, for legal or medical appointments and to attend court or work.

Durbidge cannot drink alcohol or enter premises where alcohol is served unless in a licensed restaurant nor take illegal drugs.

He is not allowed to contact the alleged victim or prosecution witnesses and cannot approach, contact or associate with any member, nominee, or prospect of any outlaw motorcycle gang.

Durbidge must continue psychological treatment, cannot apply for a new passport, nor be in possession of more than one mobile phone or use any encrypted device or app.

He has to provide details of the phone and any internet-capable device to police, and he must present himself to police to ensure compliance with the curfew and drug and alcohol abstention conditions.

The case was adjourned to February 7 next year for hearing.

An ex-Bandidos bikie who is trying to have a baby with his girlfriend has been refused bail over allegations he had a punch-on with another gang member.

Ashur Durbidge, 22, has been charged with affray for the second time after he was involved in a wild brawl between Bandidos and Rebels outlaw motorcycle gang members in Wallacia last year.

Durbidge – who told the court he has severed all ties with the gang since he was charged – was initially refused bail for the fight, which occurred in May, with another member of the Bandidos in May but was granted release in the Supreme Court.

However his bail was revoked last week when he allegedly failed a drug test and he reapplied for release on Wednesday in Downing Centre Local Court.

The court heard police attended Durbidge’s home on August 8 to conduct a bail compliance check where they allegedly found rolled up notes that had a white residue, therefore prompting officers to drug test him.

Durbidge’s lawyer Ahmed Dib said his client’s test returned a “very faint line” indicating a positive result but Durbidge claimed he had not consumed drugs and asked for another more sophisticated test at the police station, but that did not occur.

Mr Dib submitted Durbidge had a limited criminal history and was still a young man.

He said the serious matters on Durbidge’s record related to an array in 2022 where his outlaw motorcycle gang, the Bandidos, bumped into a rival gang, the Rebels, and members got into a wild brawl in a car park at the Wallacia Hotel, a notorious bikie bar in Sydney’s western suburbs. Durbidge received a community correction order for his role in the melee.

Mr Dib said the current charge of affray also related to Durbidge’s Bandidos membership and the allegation would be defended at a hearing in February, where Durbidge will claim he was acting in self defence.

The court heard on May 3, Durbidge was at a Sydney venue celebrating a birthday when he claims a group member threw a glass of alcohol at his head, who then took off his shirt and put his hands up to indicate he wanted to fight.

Mr Dib said Durbidge claimed he told the man to “go away” but when the man refused, Durbidge suggested they should go around the corner of the venue because there were families and children nearby.

The court heard the men allegedly fought and threw punches before they separated and walked away.

Mr Dib submitted Durbidge was not the “aggressor” nor did he initiate the fight, adding the case would turn on whether it was “reasonable” for Durbidge to go around the corner for a physical confrontation.

Mr Dib conceded there was a “clear nexus” between his offending and his OMCG membership.

The court heard Durbidge had since left the gang and had informed police he was no longer associated with an OMCG.

Mr Dib said Durbidge needed to be released from custody because his partner had started IVF treatment which she needed to continue otherwise there could be adverse effects on her health and body.

The court heard she went to the doctors for her first treatment on the morning Durbidge was arrested on August 8.

Mr Dib submitted Durbidge may not receive a full time sentence for the affray and had never been in prison, adding he had a financial obligation to his partner and her son.

He also noted Durbidge had spent a week in solitary confinement since his arrest over the drug test, which had been a “lesson learnt” about what happens if he breaches bail.

Magistrate Rodney Brender noted the allegation of affray was serious and refused to grant him bail given his record and the bail breach.
