A local podiatrist who was caught driving three times over the legal blood alcohol limit has been told by a magistrate he’s lucky he won’t be going to prison.
Adrian James Moore faced Picton Local Court on Tuesday pleading guilty to one count of driving with a blood alcohol limit of 0.153 – more than three times over the legal limit.
The 35-year-old Narellan man was driving at 11.20pm on January 23 in a Mitsubishi Outlander on Camden Street in Narellan with no headlights on.
Police pulled him over because his headlights and found Moore was “profusely sweating”, according to court documents.
“His eyes were dilated and glazed, and officers could smell intoxicating liquor coming from his breath,” documents stated.
According to court documents, Moore initially told police he had an “unknown amount of alcoholic drinks” and assumed he was “over the limit”.
He then returned a positive roadside breath test recording a blood alcohol limit of 0.153.
The podiatrist was arrested and taken to Narellan Police Station where he confessed to having “at least seven full strength beers and four vodka mixers prior to driving”, according to court documents.
Moore’s lawyer told the court his client had experienced a number of “traumatic situations in his past” that contributed to heavy drinking.
The most recent involved the death of his cousin, Senior Constable Kelly Forster who died while canyoning in the Blue Mountains on January 2.
In court on Tuesday, Magistrate Mark Douglass told Moore it was a “serious offence”.
“I could send you to prison but I won’t be doing that,” the magistrate said.
He noted Moore’s “excellent character and very good driving record” as well as an immediate plea of guilty.
Moore was convicted and fined $750 and had his licence disqualified for a minimum period of six months.
“Don’t drive even if it’s around the block,” Magistrate Douglass said.
