A magistrate has slammed the actions of a 28-year-old tradie who drank a six-pack of VB before riding an illegal dirt bike on a major road with his infant son in his lap.

A magistrate has slammed the actions of a 28-year-old tradie who drunkenly rode an illegal dirt bike on a major road with his infant son in his lap, telling the court he shuddered when he read the facts.

The young man, who cannot be named for legal reasons, appeared in Picton court on Wednesday after pleading guilty to mid range drink driving and riding a motorcycle while he was unlicensed.

The 28-year-old tradie told police he’d drunk six 375ml cans of VB before deciding to drive an illegal dirt bike along Dick Johnson Drive in Oran Park.

Macarthur Highway Patrol arrested a man at Oran Park on February 12 after he was caught drink-driving on an unregistered trail bike with a toddler on his lap.

At 6.45pm on February 12, Macarthur Highway Patrol spotted the man riding without a helmet while an 18-month-old toddler was in his lap who was only wearing a bicycle helmet.

When police pulled the Cobbitty resident over, a licence check showed the father-of-one was not licenced to drive a motorbike. Checks also showed the dirt bike was unregistered and uninsured.

A roadside breath test returned a positive result for alcohol, which is not surprising given he told police he’d been drinking five minutes before he hopped on the bike. The Cobbitty resident told police he’d downed six 375ml cans of VB over an hour and a half.

At the police station, the tradie returned a breath test reading of 0.117 – more than twice the legal alcohol limit for drivers.

On Wednesday, the court heard the carpenter lives with the toddler and his partner, who is pregnant with their second child.

His lawyer Karen Watson told the court her client currently has to rely on his partner to ferry him to and from worksites. She explained the 28-year-old has been riding motorbikes since he was three years old and has entered in multiple road bike competitions in the past.

Despite not having a motorcycle licence, Ms Watson said her client was experienced with dirt bikes and has taken his son to road bike trails multiple times.

Magistrate Mark Douglass said that experience meant nothing if the man crashed with his 18-month-old in such a vulnerable position.

“The road doesn‘t become any softer because he’s a motorbike rider and his son’s head doesn’t become any harder,” he said.

Magistrate Douglass reminded the court that he acts as a coroner and has seen the unfortunate results of road accidents. He said the accident could have had a disastrous conclusion.

“I shuddered when I read that particular set of facts,” he said.

Ms Watson agreed her client knew “it was an extremely stupid thing to have done”.

She said the tradie has received a number of death threats after a picture of the incident was circulated and he was identified by a logo on his shirt.

Magistrate Douglass said he would need to see photos of the incident to determine the severity. He also ordered a sentencing assessment report for the 28-year-old father.

The matter will return to Picton court for sentencing on April 28.
