Liverpool court: Mother charged with common assault after kicking child

A fashion design graduate who smashed an iPad after kicking her son in the stomach over frustrations about her divorce sobbed in relief after narrowly avoiding a conviction.

A fashion design graduate who smashed an iPad after kicking her son in the stomach over frustrations about her divorce sobbed in relief after narrowly avoiding a conviction.

A 34-year-old woman broke down in tears at Liverpool Local Court on Thursday where she pleaded guilty to common assault (DV) after she kicked her 6-year-old son on August 15 last year while her seven-year-old daughter watched.

Agreed facts state her two children were inside their bedroom with the 6-year-old boy misbehaving “due to the recent separation”.

“This misbehaving and stress resulted in the accused kicking the victim in his stomach area, which was witnessed by the other sibling,” the facts state.

A short time later she helped her children with homework when another outburst erupted when her son asked for an app to be installed on an iPad.

“However she was unable to (download the application) which caused her to become frustrated, resulting in her smashing this iPad,” the facts state.

Facts state the children became upset and their mother left them in the room to sleep before she returned and apologised.

The child later disclosed the incident to his father and reported the matter to police who arrested the mother after she conceded her “actions were unreasonable”.

“The accused made full admissions to kicking the victim, claiming that she was stressed and unable to cope at that stage due to the pressure of the separation,” facts state.

Magistrate Abdul Karim said the mother showed remorse by “co-operating with police and apologising to the child” and also “made full admissions to kicking the child”.

“The stresses of the separation … and not having any family support in Australia has caused her significant stress,” he said.

“The justice health report notes church friends are her only support network in Australia.”

The mother was sentenced to a 18 month conditional release order without a conviction.
