A western Sydney man has been jailed for four years over the horrific assault of his 13-year-old daughter which left her crying in pain and needing surgery.

Protections had been in place for two years to prevent the father, who cannot be named, from going near the child when he viciously assaulted her and then went for a nap, according to court documents.

Last Thursday he was jailed for four years in the Burwood Local Court after the detail of his sick assault was laid bare.

According to his court file his daughter ended up at the family home in August despite police orders in place preventing him from being in contact with them.

The girl had got into a fight at school.

The attack began after the man, 33, “started screaming at the victim ‘hello am I talking to a wall’” according to court documents.

“(He) started punching the victim to the head and as she crouched down in the corner he began kicking her in the side of the body,” the agreed facts state.

“(He) returned to the lounge and fell asleep. The victim was crying and in pain from the assault.”

The father later kicked the child to the hand, fracturing it in two places, and said “I don’t care” after they had burnt sausages – according to court documents.

The child told police she “had never felt pain like that before” and needed surgery to have two metal pins inserted into her hand.

Court documents show the child’s mother told them “don’t say anything” after a hospital visit which confirmed the injuries to her hand and resulted in her wearing a cast for 12 weeks.

The incident played out two years after the man was convicted of stalking and intimidating the same child.

The man was prevented from going near the child after the similarly frightening incident over a spilt cup of tea in 2018 but still managed to have access to her two months ago.

“Police believe that preventing the accused from having any contact with the victim is crucial for her overall wellbeing and welfare,” police wrote in court documents at the time.

His criminal history includes convictions for armed robbery, assault, drug offences and domestic violence offences.

He had pleaded guilty to contravening an AVO, common assault and assault occasioning actual bodily harm.

He will be eligible for parole in November 2023 after serving three years in prison.
