A West Ryde student allegedly “dragged” a woman to his house and threatened to kill her family, just months after an apprehended violence order was put in place for the woman’s protection.

Kaushal Khati faced Burwood Local Court on Monday where he pleaded not guilty to three counts of assault causing actual bodily harm and three counts of common assault.

The accused has also been charged with two counts of breaching an AVO, two counts of destroying/damaging property and one count of stalking/intimidation.

Mr Wood told the court a few months after the first matter, Khati allegedly “asserted control” over the woman to the point where he “dragged” her back to his house and threatened to kill the woman’s family while he was on bail.

He said some of the alleged assaults took place in public places.

Mr Wood said he was concerned Khati’s liberty could lead to the accused interfering with the woman’s evidence or contributing to the woman’s unwillingness to continue with court matters.

Khati’s lawyer Mohammad Wafai said his client’s young age and non-English speaking background made him vulnerable in jail, where he has spent the last five months on remand.

Mr Wafai requested his client be placed on an intensive corrections order and insisted Khati could follow bail conditions, including being placed under house arrest, to prevent him from reoffending. He said Khati has no previous criminal history.

Mr Wood added Khati’s non-English speaking background is “not unusual in our multicultural society”.

“He has had no time to mount a clean record as he is on a student visa and has only been in Australia for a bit,” he said.

Magistrate Christopher Halburd granted the bail application under the condition Khati report to police daily, surrendered his passport and have no contact with the woman.

The case has been adjourned to May 26 for a hearing.
