Max Cleary: Manly man’s alleged rape case waiting on doctor’s evidence

A court has heard police will rely on the evidence of a doctor in their case against a Manly landscaper and son of a former Sea Eagles CEO who it is alleged to have sexually assaulted a young woman. The court heard the doctor’s evidence related to injuries allegedly suffered by the complainant.

Police will rely on evidence from a doctor in their case against a northern beaches man accused of sexually assaulting a young woman he met on social media, a court heard.

The Newtown Local Court on Thursday was told charges of sexual intercourse without consent against Max Cleary, 22, are facing a delay because police are waiting on a key piece of evidence.

The material detectives are waiting on, the court heard, is an expert statement from a medical doctor about the injuries the young woman allegedly sustained during the encounter.

Cleary is the son of Catholic school principal and former Manly Sea Eagles CEO Tim Cleary.

Max Cleary is charged with having sex with a young woman without her consent in Camperdown on August 15, according to court documents.

Police will allege Cleary met the young woman on social media before inviting her out for drinks in the city.

After finishing their drinks, it is alleged, Cleary invited the woman back to a friend’s house in the inner west where she says she was then sexually assaulted by the landscaper.

Cleary is not allowed to associate with the friend as part of his bail as police say he was a witness to the alleged sex assault.

The former private schoolboy had a second job at a disability care home and was working seven days a week before his arrest but his movements are now restricted while free in the community.

His use of a phone is being strictly monitored while on bail and Cleary is on a curfew at his family’s Manly home.

He also has to report to police every day, cannot drink alcohol and is banned from entering Camperdown.

Cleary appeared in a sharp blue suit and face mask with his lawyer before Magistrate Greg Grogin on Thursday.

His case was adjourned to be heard in the Downing Centre later this year where his charges are expected to go up to the District Court.
