A former boxer who was once gunned down over a feud with his ex-girlfriend’s family has allegedly been caught in possession of a pistol, faked drug prescriptions and terrorised a woman in the space of two months.
Joshua Smart was taken into custody earlier this year when police allegedly found him with a black gun on a sunny afternoon in Leichhardt on February 12.
The 29-year-old is subject to a firearms prohibition order, according to court documents. He has pleaded not guilty two weapons offences.
At the time the Pyrmont man was also in possession of GHB, an offence he has pleaded guilty to.
After receiving bail he was arrested again a month later on allegations he forged prescriptions for prohibited drugs on the notepads of registered doctors.
It will be alleged in court Smart obtained Alprazolam and Diazepam – more commonly known as Xanax and Valium – using the fake notes on four occasions between March 11 and 14, at facilities in Surry Hills, Pyrmont and the CBD.
This month Smart was hit with four more charges, including two of assaulting the same woman at Bondi Junction on April 8 and 10, contravening an AVO and stalk and intimidate.
He also faces a charge of contravening an AVO laid on February 22.
However, his latest efforts to navigate the legal system have been hampered by coronavirus.
The Central Local Court this morning heard Smart is currently self-isolating in Parklea Correctional Centre, where he is on remand, meaning his lawyer has been unable to obtain any instructions from him.
Smart was sentenced to a maximum of three years’ prison for concealing an indictable offence after he refused to give police the name of the man who shot him in the back outside the family home in April 2014.
Smart’s father was also left with a bullet lodged in his brain and requiring full-time care.
The culprit of the Romeo and Juliet-style shooting, Corey George Farrell, the brother of Smart’s then girlfriend, was sentenced to seven years in jail.
