Domestic violence charges against a high-profile Sydney property developer have been sensationally thrown out after his wife failed to show in court as a witness, who immigration have said is currently “offshore”.
Jean Nassif, 54, was charged with common assault and intimidation with intent to cause fear – and an apprehended violence order (AVO) – which were dramatically withdrawn by the police prosecution after the complainant, his wife Nissy, failed to show up in court as a witness.
The court heard Nissy, 34, who Mr Nassif had once bought a $480,000 Lamborghini, was served a subpoena to attend court but had instead travelled overseas to Lebanon, with no return date set.
The police prosecutor attempted to contact Nissy in Beirut – where there is a seven-hour time difference – to no avail, forcing the hand of Magistrate Peter Bugden.
“The interests of justice also extend to Mr Nassif,” he said.
“The witness isn’t here to help the court come to a decision, and I’m not prepared to adjourn the matter.”
Police had alleged that Mr Nassif punched his wife four times in the face, slapped her, and dragged her around the room in his Chiswick home – the court heard – which made her “fear for her life”.
Mr Nassif had pleaded not guilty to all charges.
Magistrate Bugden said after considering the information in front of him he could not adjourn the case, and the two charges and AVO were withdrawn.
Mr Nassif declined to comment outside the court.
