A Wollongong man has been sentenced for attacking his mother with a stick despite strenuously denying ever picking up the weapon.

A Wollongong man has avoided a jail sentence for a doped-up attack on his marijuana-sharing mother.

Matthew James Mitton faced Wollongong Local Court on Monday where he maintained guilty pleas to two counts of possessing a prohibited drug – namely cannabis.

However, the 25-year-old opted to challenge a charge of assault occasioning actual bodily harm dating back to an incident in July, last year.

The court heard Mitton had been woken by his mother so she could drive him to a doctor's appointment.

The two argued in the car with Mitton alleging the woman was driving erratically which spurred him to say “What are you doing, stupid?” and told her to let him out.

Mitton told the court his mother wouldn't let him out of the car, alleging when he opened the door she would start speeding off.

However, Police prosecutor Sergeant David Weaver opined Mitton had not wanted to exit the vehicle and instead was looking to continue bickering with his 62-year-old mother.

The court heard Mitton eventually got out of the car near Wollongong‘s WIN Stadium and made his own way home on foot.

“When I got home we were still arguing,” Mitton said.

“I said ‘F**k you, I hate you’ and went and put my headset on and she called the police. There was nothing I could do so I started smoking some of my cannabis.”

However, Mitton missed a key detail, being he went outside and found a stick to use as a makeshift weapon which he used to lash his mother on the back.

Mitton denied this occurred, however, Magistrate Claire Girotto observed pictures of the injury that were “highly consistent” with such an attack.

Ms Girotto also pointed to Mitton being heard in the background of the triple-0 call as a compelling factor in the case.

Senior Constable Joshua Dietrich gave evidence that Mitton was found smoking a bong when police arrived with the offender telling the court he and his mother were “full-time smokers” and ”would get on it together”.

Ms Girotto convicted Mitton of all three charges, however, imposed no further penalty for the two drug matters.

For the assault charge, Mitton was dealt a 12-month community corrections order with an apprehended violence order put in place between him and the victim for two years.

Mitton, however, will remain behind bars on remand with the court hearing he was charged following a “more serious matter that happened over Christmas”.

Mitton was charged with wounding a person with the intent to cause grievous bodily harm and being in custody of a knife in a public place.

The charges relate to an alleged stabbing outside the Harp Hotel, a popular night haunt in the Wollongong CBD.

The matter will return to Wollongong Local Court at a later date.
