‘Spontaneous’: Sydney creep Evangelos Nussis sentenced for sexual intercourse with 15yo

A grocery store worker who raped a 15-year-old girl at beaches and hotels told a court he never intended to have sex with her, insisting it was “spontaneous”. Warning: Graphic content.

A Sydney sex criminal who caught the train to Wollongong on multiple occasions to rape a 15-year-old girl at the city’s beaches and nearby motel will be behind bars until 2026 after being sentenced on Wednesday.

Evangelos Nussis, 29, pleaded guilty in Wollongong Local Court earlier this year to seven counts of sexual intercourse with a child between 14 and 16.

The Greenacre man fronted Wollongong District Court after spending the last three months in custody on remand at Goulburn, Silverwater and Parklea jails.

The court heard Nussis connected with the victim when she was 14-years-old via the popular online game Fortnite in 2019, then added her on Discord and Snapchat.

The predator soon began catching the train to the Illawarra region to have sex with the minor, who had since turned 15.

The offending occurred at various locations including on the sand at Wollongong Beach, nearby beach huts and the City Beach Motel.

A pre-sentence hearing on disputed facts about Nussis’ offending, specifically over whether he was wearing a condom on four of the occasions despite admitting he had not worn a condom on at least one instance, was conducted on Tuesday.

Judge Alister Abadee concluded Nussis was not wearing a condom on one of the occasions, however, he said there was not enough evidence to determine whether he did on the other three beyond reasonable doubt.

The victim gave evidence and read an impact statement in a closed court on Tuesday with Judge Abadee recounting during sentencing how she felt an “overwhelming sense of shame and pain” and found it “difficult feeling secure in intimate moments”.

Nussis also took to the witness box where he said on the first occasion – at Wollongong Beach – the pair had unprotected sex “spontaneously”.

The court heard about a message exchange between Nussis and the victim about one of her friends, aged 15, having a relationship with someone over 18.

“I can’t talk lol,” Nussis said in one of the messages.

“Yeah it’s bad but I can’t say anything get me?”

The court heard the girl had “significant vulnerabilities”, and Nussis’ barrister Phillip Butterfield submitted his client was “aware” of them but “didn’t take advantage” of them.

Judge Abadee pressed Mr Butterfield if Nussis considered himself in a boyfriend and girlfriend relationship with the victim.

“They were engaging in relations,” Mr Butterfield said.

“Answer my question, would you characterise it as a boyfriend and girlfriend relationship,” Judge Abadee responded, to which Mr Butterfield said, “Yes”.

Nussis told the court about the arduous conditions in custody, particularly at Parklea where he claimed he was in isolation and went without food for two days.

He also said he had received threats from other inmates through his cell door which left him feeling “complete agony and s**t”.

“I feared for my life and my safety,” Nussis said. “I wasn’t mentally stable because I didn’t have my [sleep apnoea] machine and meds.

“I have been hearing about people with similar charges to mine have been basically bashed.”

When handing down his sentence on Wednesday, Judge Abadee found Nussis had demonstrated contrition, but said his “regrets were more to do with the consequences from his offence to his current predicament”.

Nussis was sentenced to five years and six months jail with a non-parole period of three years. With time already served, he could be eligible for parole in May, 2026.

A two-year apprehended violence order to protect the victim from Nussis was put in place upon the guilty plea in January.
