An Illawarra woman who claims to be able to see the future has threatened to take the RSPCA to the NSW Supreme Court after withdrawing her civil action in Wollongong Local Court.

Madeline Rose, 56, told the court via audio link on Tuesday of her intentions to take her case to the Supreme Court despite still facing a string of animal cruelty charges.

The Cringila woman began the civil suit after she was charged with five counts of aggravated cruelty upon an animal, four counts of failing to provide vet treatment and a further three counts of cruelty upon an animal.

Rose, a self-published young fiction writer and vocal anti-vaxxer, has pleaded not guilty to all of the charges.

The RSPCA is alleging Rose mistreated at least 60 cats and kittens at her home, which required six to be put down.

Court documents state Rose allegedly kept the cats in “dirty and unhygienic” conditions which led to them being “unreasonably, unnecessarily and unjustifiably inflicted with pain, suffering and distress”.

The animals that had to be put down because it would have been “cruel to keep them alive” were allegedly suffering from myriad of conditions including chronic cat flu, neurological issues, stress, flea allergy dermatitis, periodontal infection, ocular and nasal purulent discharge, infected dental disease and general poor body condition.

The RSPCA rescued cats and kittens from Rose in March last year, with the organisation alleging 25 were suffering significant dental disease, 10 were in a poor bodily condition, nine were afflicted by upper respiratory disease, seven had conjunctivitis and four had entropion.

The lawyer representing the RSPCA, Patrick Schmidt, said he had received an email from Rose stating she was a “living and breathing woman” and she was “not able to proceed against the co-operation”.

The email went on to state Rose would withdraw the Local Court level legal action and recommence it in the Supreme Court.

Rose, who abruptly told Magistrate Michael O’Brien to refer to her as Colleen Madeline, also said she “didn’t consent to the RSPCA’s offer”.

Mr Schmidt indicated a hearing into the criminal matter was set down for next week and it would take “numerous vets and resources” from the RSPCA.

With Rose maintaining her not guilty plea the hearing is expected to go ahead next Wednesday.
