Noel Mahon: Director of Mahon Civil Contractors found not guilty of domestic violence charges

The head of a civil construction firm has been found not guilty of multiple domestic violence-related charges associated with his long-term partner.

The head of a civil construction firm has been found not guilty of multiple domestic violence-related charges associated with his long-term partner.

Noel Oliver Mahon, 45, faced a hearing in Wollongong Local Court last year after he pleaded not guilty to being armed with the intent to commit an indictable offence and assault occasioning actual bodily harm.

Mahon, of Blackbutt, also pleaded not guilty to choking, intimidation, three counts of common assault and four apprehended domestic violence order breaches.

The Mahon Civil Contractors boss was accused of holding a knife to his partner’s face and threatening “I am going to kill you”.

The police also alleged Mahon had a fight with the woman in his Toyota Hilux where he grabbed her hair and slammed her head into the vehicle.

Magistrate Mark Douglass found Mahon not guilty of these offences on Monday, three weeks after he began handing down his decision before an administrative error forced an adjournment.

The magistrate had described the complainant as an “unreliable” witness and the police were unable to establish key aspects of the prosecution case to the requisite standard of beyond reasonable doubt.

Mahon had pleaded guilty to one count of common assault and two counts of contravening an ADVO.

Mr Douglass fined Mahon $500 and sentenced him to a 16-month community correction order with the condition he participate in domestic violence programs as directed.

An ADVO was put in place for the protection of the complainant for a period of two years.

The finalisation comes seven months after Mr Douglass sentenced Mahon to a nine-month intensive correction order after he pleaded guilty to two counts of contravening and ADVO and intimidation.

The victim connected to these charges was a male friend of the woman he had been in a relationship with for about a decade.

Court documents state Mahon made a series of threatening voicemails to the man where he said he would “f-----g burn” him and “I’m going to take your life”.
