A Warrawong man has been granted bail even though he is accused of a string of serious offences against his ex-partner after his lawyer argued there was a “dark cloud” over the case.
Kyle John James Tilley appeared in Wollongong Local Court on Monday charged with assault occasioning in actual bodily harm, aggravated break and enter, destroying or damaging property, stalking and intimidating, larceny and contravening and AVO.
Tilley, 22, has pleaded not guilty to all six charges.
Police allege the offending occurred over a four-year period, however it came to a head on the night of Sunday, May 22 when Tilley is alleged to have smashed open a window in an attempt to gain access to his former partner’s Berkeley home.
Police further allege that the alleged victim feared more property would be damaged, so she opened the door when Tilley told her to give him her phone.
Police say further that the alleged victim refused, before he grabbed it off her and hit her multiple times in the face which allegedly caused her face to swell up.
Tilley allegedly pulled a knife out of his pocket and stabbed himself an unknown amount of times in his stomach with the victim later telling police she thought he would turn the knife on her.
Police allege Tilley then left the house before returning and stripping down the CCTV hard drive and taking it with him.
The alleged victim waited four days because she allegedly to scared to report the incident, before telling police about the “fearful” night and Tilley’s “numerous” AVO breaches.
In court on Monday, Tilley’s solicitor Paul Paine prompted him to lift his shirt up before saying there was a “dark cloud over the entire story” given there weren’t any stab wounds on the accused’s torso.
Police prosecutor Sean Thackray showed Magistrate Claire Girotto a photo of the alleged victim’s black eye, but she said “There’s no black eye, there’s some darkness (under her eyes), but that could be from a lack of sleep and everyone in this courtroom suffers from a lack of sleep”.
“Upon reading the facts, if he’s found guilty he is going away for a long time,” the magistrate said.
“The absence of marks on his body makes it a weakened case.
“I want to protect the victim so the only option is house arrest.”
Tilley will be required to live with his mother and he is not allowed to leave without her being with him.
Tilley will be back in court on Wednesday, July 27
