A violent sex offender who was locked up for 10 years is back behind bars after breaching multiple reporting conditions.
Jeffrey Cusack, who spent a decade in prison for an aggravated sexual assault at the start of the millennium, was arrested on Tuesday charged with multiple failures to comply with reporting obligations under the Child Protection Act.
The arrest came a day after Cusack appeared in Kiama Local Court for a boozed-up crash in May when he careered his white Subaru Impreza into a barrier on King St, Warrawong.
Cusack, who lives in Primbee, blew nearly three times over the blood-alcohol limit and was convicted, however, he escaped any further penalty.
After leaving Kiama, Cusack attended Lake Illawarra Police Station as part of his annual reporting obligations where the 59-year-old told officers that he wasn’t a member at any club and he didn’t use social media.
Cusack was barred from being a member of any club which included children memberships and required to notify authorities with any online accounts he registered.
However, police allege after a search of Cusack’s Windang Rd address, police seized a mobile phone with Snapchat and TikTok downloaded.
The username ‘jeffrogun’ was logged in on Snapchat while the TikTok app wasn’t logged in.
The search also unearthed a Club Windang membership card – a Lake Illawarra foreshore social club fitted out with a children’s playground.
According to documents tendered in court, during an interview with police at Lake Illawarra Command, Cusack revealed he had been a member of Club Windang for “several months” with the man describing the breaches as an “oversight”.
In Wollongong Local Court on Wednesday, Cusack’s convoluted circumstances continued with him telling Magistrate Chris McRobert “I didn’t put Snapchat on my phone, my mate did”.
“You didn’t delete it though did you,” the magistrate responded.
Cusack grovelled that he needed “one more chance to turn everything around”.
“You’ve never said that in court before?” Magistrate McRobert said.
“No I haven’t,” Cusack replied.
“Mmmmh,” sounded the magistrate who went on to say Cusack “faces near inevitability of full-time imprisonment” and denied him bail.
Magistrate McRobert adjourned the matter for two weeks for a plea to be entered, however, Cusack interjected “I plead guilty then”.
“Do you want to seek legal advice,” the magistrate asked.
“I don’t need it, I’m guilty,” was Cusack’s response before his Legal Aid lawyer Danny Lagopodis urged the magistrate to continue with the two-week adjournment.
