A young man failed to maintain an erection during a session with a sex worker, so he removed his condom without consent in an act commonly referred to as stealthing.
Adrian Perez, 21, fronted Wollongong Local Court on Wednesday, where he pleaded guilty to one count of sexual intercourse without consent.
Documents tendered in court state the female victim specialised in various areas, including BDSM which Perez inquired about after an initial session involving consensual oral sex.
The woman replied BDSM – which stands for bondage, discipline, sadism, and masochism – required a great deal of trust to be established beforehand.
On April 28, 2022, the Figtree man contacted the woman at 4pm and booked a half-hour session with her for 5.30pm.
Documents state it was discussed the victim would be restrained, gagged and blindfolded during the session, with the woman telling Perez the use of a condom was a non-negotiable, which he acknowledged with “yep”.
The pair agreed on a $400 fee with an extra fee for spanking.
The documents indicate Perez entered the woman’s abode and engaged in some light spanking before she put a blindfold on.
The victim heard the offender open a condom packet and felt him try and fail to insert his penis into her anus.
The documents state Perez removed the condom without the woman’s consent or knowledge before he thrust his penis into her vagina and ejaculated.
The victim told police Perez was quite vocal when he ejaculated and said, “I had a bit of an explosion”.
Perez told the victim there was ejaculate on the floor, and she felt some between her legs.
The victim noticed the condom on a seat behind her but assumed it had split with the two chatting for a few minutes before Perez left.
When the woman was cleaning up, she saw the condom was completely intact.
Court documents state the following day, the woman confronted Perez via text messages where she wanted to “discuss what happened”.
“This will be a lot easier if you’re honest as I have proof,” she said.
“I want an apology immediately for you taking your condom off and f***ing me without it.”
During the message exchange, Perez said he took the condom off and ejaculated but denied he “put it back inside”.
“Well I’ve apologised and I do mean it,” Perez said.
“Yes your right what happened and I was scared what to say because I couldn’t get hard and I actually am so sorry like seriously.”
The victim reported the sexual assault and went to Wollongong Hospital for a sexual assault investigation kit.
Police found Perez’s number was registered in his father’s name and linked to the offender’s Figtree address.
The offender was arrested in September, and the same month test results revealed his DNA was traced on a vaginal swab of the woman and the condom.
Perez’s bail was continued, and he will learn when he will be sentenced in Wollongong District Court in June.
