A Wollongong man who was due to walk out of Nowra jail on parole on Friday has been prevented from leaving after he was slapped with fresh charges.
Garrett William Dunn appeared at Wollongong Local Court where he applied for bail after he was charged with three counts of intimidation and contravening an apprehended domestic violence order.
Dunn was serving a three-year sentence of imprisonment at South Coast Correctional Centre and was due to be released on Friday but police charged him with the fresh offences.
Police allege Dunn, while in custody, made more than 700 phone calls to the alleged victim, some of which contained direct threats this year.
Police prosecutor Amelia Wall submitted the prosecution case against Garrett was strong because all calls from the jail were recorded.
She said there were serious concerns for the safety of the alleged victim who was a protected person under the apprehended violence order (AVO) against Dunn.
Dunn’s defence lawyer Emel Ozer said the charges being laid on the day her client was supposed to be granted parole had caused Dunn “significant distress” as would being refused bail.
She conceded the case against Dunn was strong but noted the AVO had been amended to allow contact between the pair in October.
Ms Ozer also submitted Dunn’s mother would allow him to live at her Bulli home and supervise him while he was under house arrest conditions.
Ms Ozer added Dunn would agree to abide by the AVO and have no contact with the alleged victim, and his mother could provide a $3000 surety to ensure he complied with his bail conditions.
Registrar Tina McKenna noted the prosecution case appeared strong due to the large number of calls allegedly made, adding the case was serious because there were allegations of threats.
She said given Dunn was already serving a custodial sentence when he allegedly committed the further offences, Dunn could face another term of imprisonment if convicted.
Dunn was refused bail with the case adjourned to January 9 at Nowra Local Court.
