Nathan Mondon sentenced after getting machete out in Mt Colah road rage incident

A road rage incident in Sydney’s upper north shore escalated when a driver took out a torque wrench tool from his car, unaware the other driver had a large machete.
When Nathan Mondon, 26, of Asquith was approached by a driver with the tool in his hand, he decided to show him his 20cm machete, leading to the other driver fleeing, according to court notes.
Mondon, a concreter and father, appeared at Hornsby Local Court on September 16 for sentencing after pleading guilty to charges; armed with intent to commit indictable offence; two counts of custody of knife in a public place and commit s114 offence having previous conviction.
According to police facts the incident happened at 4.30pm on March 21 when a man named Wayne Bingham was driving northbound on the Pacific Hwy in Mount Colah when Mondon suddenly turned onto the road in front of Mr Bingham, causing him to “brake heavily”, police facts state.
The two drivers began to overtake each other and eventually came to a stop near the intersection of Beryl Ave, police facts explain.
Court documents reveal Mr Bingham left his car with a “torque wrench” and approached Mondon where the two men got into a heated argument.
Mondon left to get a machete out of his car as Mr Bingham returned to his vehicle.
“The accused has approached victim holding the machete in his right hand above his head”, police facts state.
In response, Mr Bingham fled from the scene in his car and reported the incident to police when he got home.
Police were able to track down Mondon’s car from the description and he was stopped by police where he admitted to having a machete, stating “yeh this guy came at me with a spanner or something so I got out a machete” and “I live in Blacktown. I had it for a while, for protection”, police facts state.
He was arrested and when police searched the Mitsubishi they found two knives with Mondon stating the second knife was used to “cut apples at work”.
During court proceedings Mondon’s lawyer explained to the court his client was in a “difficult position”.
“My client has some anger issues he has to deal with. He said he just reacted. He’s confessed everything,” the lawyer said.
“He was somewhat provoked by the victim. He was under some duress. He’s got reasonable prospects of rehabilitation if he’s dealt with by an ICO. He’s taking medication and getting help.
“He’s had a nasty accident and a number of operations your honour. I think you know what happens with young men with physical problems in custody.”
In response Magistrate Alex Mijovich said “there has to be some form of deterrence”.
“A threshold has clearly been crossed.
“I stress this is a jail term. If you commit any other offences, you’ll be going into full time custody.”
Mondon was convicted and ordered to undertake two Intensive Corrections Orders with a combined period of 14 months and is required to pay a monetary penalty of $1600 in total.
