An innocent worker at a convenience store was forced to defend himself after an enraged man stole a cigarette lighter and attempted to hit staff and customers with knuckle dusters.
Jordan Sigley, 26, of Wahroonga was sentenced at Hornsby Local Court on Wednesday after he was found guilty of possess or use prohibited weapon without permit and larceny.
Late at night on June 4, Sigley entered the Ezymart convenience store on the Pacific Hwy in Gordon where he attempted to purchase three cigarette lighters but his card was declined.
Police facts state, Sigley, “a self confessed cannabis user”, stole a blue coloured cigarette lighter, walked out of the convenience store and began banging his hands on the window while swearing at a staff member who was serving another customer.
After the outburst, the staff member decided to go to the entry of the store while holding a red pole and asked Sigley why he was “banging on the window and yelling at him”, court documents state.
In response, Sigley walked into the store and raised a hand at the staff member aggressively, causing fear to the store worker who “believed he was going to be hurt”, police facts sate.
Sigley then “attempted to hit” the staff member and customer with a knuckle dusters, court documents read.
Soon after Sigley left the store and the staff member locked the doors and informed his boss of what happened before Sigley returned, spitting at the window of the shop, police facts state.
About 11pm police attended the scene where they saw Sigley sitting outside the store entrance and he was searched.
Officers discovered in his pocket a blue cigarette lighter which was stolen from the convenience store and when police spoke to the victim inside, “they located a set of knuckle dusters grey in colour on the floor of the store where the accused had been standing”.
Sigley was being questioned and he admitted to carrying the “knuckle dusters” for his own protection.
During court proceedings on Wednesday Magistate McGlynn said he was facing potential jail time.
“Do you know what the penalty is for use of a prohibited weapon? It’s 14 years, that’s quite a big whack of your life,” Magistrate MGlynn said.
“I can’t fathom what you could need knuckle dusters for your protection and the facts show you tried to use them on a citizen.
“You attempted to hit the victim and had the knuckle dusters on your hands at the time.”
Sigley said “I dispute that your honour, I had them in my pocket”.
But the magistrate wasn’t buying it and noted he had committed other offences involving drugs and destroy or damage property.
“You threaten members of the community and you lose benefit of the doubt.”
He was convicted and received a community corrections order for 12 months.
