According to police facts tendered in court, about 2.20pm on July 25, Kilpatrick was driving a black Holden Commodore north along Redleaf Ave in Wahroonga when he veered onto the wrong side of the road and crashed into six cars including a Toyota LandCruiser, a Toyota Corolla, a Mitsubishi Lancer, two Mercedes, and a Toyota Yaris.

Court documents reveal the primary school teacher continued to drive until he smashed his car into the railway bridge, which forced his vehicle to come to a stop.

He was then witnessed attempting to get into a stranger’s car at a roundabout and he “started to punch the sky in a celebratory manner”, police facts state.

Horrified, three witnesses began to chase Kilpatrick and as a passer-by attempted to get hold of him, Kilpatrick punched him, “causing the victim’s ear to bleed”, police facts state.

A number of police officers were forced to “wrestle with the accused” so he could be put in handcuffs but he continued to resist police by “kicking out at police, blocking the door, and attempting to push and shake police off him” as they tried to put him in the back of the police vehicle, police facts state.

Eventually, ambulance officers had to sedate and restrain the out of control music teacher and he was taken to Hornsby Hospital where he got blood and urine tests.

During court proceedings Kilpatrick’s lawyer Tuan Phan made a section 32 application upon mental health grounds but Magistrate Margaret McGlynn rejected it.

“He was driving and had smoked cannabis, There is clear evidence your client was self-medicating due to existing conditions including paranoia, he didn’t behave in a normal fashion,” Magistrate McGlynn said.

He was convicted, received a conditional release order for 12 months and was disqualified from driving for one year.

Kilpatrick was offered a comment outside of court but declined.
