Malcolm Best found not guilty of sexual touching charges

A man who was accused of sexually touching a girl and asking a boy to show him his genitalia has been found not guilty of the offences.

A man from The Hills who fought sexual touching charges has been found not guilty following a hearing at Parramatta Local Court.

Charges against Kenthurst’s Malcolm Best were dismissed after a hearing in March, when the court heard how Best was accused of tickling a girl’s “front bottom” twice in 2020 and asked a boy to show him his penis.

Mr Best pleaded not guilty to two counts of intentionally sexually touching the girl between June and Boxing Day 2020. No plea was entered for intentionally incite child 10 years do sexual act to them.

During the March hearing, the girl was cross examined and footage was played from her interviews with police in January 2021 and July last year.

The court heard how Mr Best allegedly touched her vagina through her clothing on Boxing Day at Kenthurst after he asked her to “come over here”.

Mr Best was also accused of sexually touching her at Toongabbie in October 2020. This charge was dismissed.

During the girl’s cross examination, defence barrister Rob Steward suggested several people were around when Mr Best allegedly touched her on the two occasions.

Mr Best denied being alone at any time with the girl or sexually touching her.

During an interview with police last year, which was played to the court, the boy alleged Mr Best said “I also thought there was a possibility you should show me” his penis while they were at a property in Kenthurst on Boxing Day in 2018 or 2019.

On May 9, Magistrate Cate Follent found him not guilty of each offence and charges were dismissed.
