Elderly man shoved, kicked in Castle Hill

POLICE have confirmed two teenage boys involved in a shocking incident in Castle Hill where an elderly man was shoved to the ground and kicked are being dealt with under the Young Offenders Act.

The 70-year-old man fractured his cheek and suffered a cut to his head in the attack which happened outside Castle Towers shopping centre on Saturday, August 18 about 8.50pm.

A video of the ugly incident was widely circulated on social media.

Police spoke with all three people involved and said the two teenagers were now being dealt with under the Young Offenders Act.

The man, 70, fractured his cheek and suffered a cut to his head in the attack.

Further inquiries are continuing and the elderly man may still face a charge, police said.

Following the incident, The Hills police commander Superintendent Rob Critchlow told the Times there was more to the incident than what appeared on the video and all three people involved could be charged, including the elderly man.

“Other CCTV gives a wider, more comprehensive view of all the lead up events and the incident itself.

“The consumption of alcohol by some of the parties appears to be relevant.”

Police said there was more to the incident than what appeared on the video shared online.

Police also urged the public to refrain from vitriol and threats on social media against the parties involved, and to leave the incident to police.

The Young Offenders Act provides an alternative process to court proceedings for dealing with children (aged 10 to 17) who commit certain offences through the use of youth justice conferences, cautions and warnings.

A youth justice conference can result in a child making an oral or written apology to any victim, the making of reparation to any victim or the community, participation by the child in an appropriate program, and the taking of actions directed towards the reintegration of the child into the community.

However, that is not an exhaustive list of the “decisions and recommendations that may be contained in an outcome plan” as part of a youth justice conference.
