A Fairfield teenager who allegedly stabbed a man he claimed was trying to sexually assault his mother has had his charges dropped by police.
On March 23, the 19-year old had woken up and walked downstairs to find a 54-year old man having sexual intercourse with his unconscious mother, his lawyer Daniel Gaudiello of Mayfair Lawyers had previously told the court.
At a bail hearing for the teenager, Fairfield Local court heard the 19-year old then allegedly walked back upstairs, grabbed a knife, and returned, stabbing the victim in the back, with a serious amount of blood spurting out.
The court heard that police were called anonymously, and when they arrived, the 54-year old had fled.
Shortly after the 19-year-old man was released on bail and the 54-year old man was charged with sexual offences.
At a bail hearing at Fairfield Local Court on March 29, the court heard the older man was kicked out of the home by the 19-year old without his pants or underwear.
On September 19, the 54-year old was convicted of carry out sexual act without consent, and sentenced to a term of 12 months imprisonment, with a non-parole period of nine months.
He was released on parole on September 27, after time served in custody was taken into account.
The 19-year old who stabbed him did not have their charge of wounding with intent to cause grievous bodily harm dropped until October 17.
“Our client is a young man who displayed great bravery and courage in the face of grave danger,” Mr Gaudiello said.
“He acted valiantly in extremely confronting and perilous circumstances as he perceived them to be.”
“We commend the New South Wales Police in supporting our position to have all charges withdrawn and dismissed after their thorough consideration of this proceeding.
“Our client is looking forward to moving on with his life and putting the trauma of this incident behind him.”
