Fairfield: 19-year old bailed on grievous bodily harm charges

A teenager facing charges relating to allegedly stabbing a man in the neck has told the court he was witnessing the man allegedly sexually assaulting his mother.

A 19-year old has claimed he was defending his mother from a sexual assault when he allegedly stabbed a man in the neck on March 23.

Police have charged the Fairfield teen with wounding with intent to cause grievous bodily harm, and a bail application was heard at Fairfield Local Court yesterday.

His lawyer, Daniel Gaudiello, told the court that his client woke up and walked downstairs to find the alleged victim having sexual intercourse with his mother, who was unconscious at the time.

The court heard that the teen then allegedly walked back upstairs, grabbed a knife, and returned, stabbing the victim in the neck, with a serious amount of blood spurting out.

Mr Gaudiello noted that the teen’s father died at a young age, and he is particularly close with his mother.

His mother had been taken to hospital for further investigations in relation to the allegation of sexual assault.

The court also heard that police were called anonymously, and when they arrived, the alleged victim had fled, and has not given a statement to police since.

Magistrate James Gibson granted bail, citing the potential delays in the court system, and the possibility that a full-time custodial sentence may not be given even if Mr Smith were to be found guilty of the alleged wounding with intent charge.

The bail conditions included daily reporting at Fairfield Police Station, not to leave home except in the company of his mother, and to not go near or contact the alleged victim.

The 19-year old is due back in Fairfield court on May 23.
