Two women are alleged to have been stabbed overnight on Friday — one in the neck, and one in the back, following two separate alleged incidents of domestic violence in Sydney’s west.
Vietnamese national Ba Duy Le 37, was refused bail in Parramatta Local Court on Saturday, charged with domestic violence related reckless wounding; intentionally choking a person without consent; common assault; destroy or damage property and two counts of stalk/intimidate.
It will be alleged about 11pm on Friday, police were called to Mallee St, Cabramatta, and found a 34-year-old woman with an “obvious” stab wound in her back.
Police will allege the inside of the home was in a state of disarray, with blood on the bathroom and kitchen floor and a broken sliding door, with a knife allegedly found laying on the ground in a puddle of red wine.
The court heard, when speaking with police on the evening, Le allegedly told police through a Vietnamese interpreter that him and the alleged victim — who he is understood to be in a de-facto relationship with —“were play fighting”.
Prosecutor Sergeant Chung Shieh told the court it was a strong prosecution case and Le posed the risk of fleeing the country or further endangering the victim if granted bail.
Sergeant Shieh also said police allege the up-ended, and disordered scenes inside the home were consistent with a stabbing.
In response a Legal Aid solicitor disagreed it was a strong prosecution case, noting the alleged victim’s hostility toward police and Le’s lack of criminal history.
“I understand the police have submitted the state of the home would confirm the allegations before the court, I disagree with that”, she said
“Its conceded perhaps they saw the home was messy and there was a broken sliding door, all that confirms is there was some damage.
“It doesn’t confirm who caused it and whether it occurred on that particular date.”
The solicitor also said a friend of Le’s had offered $1000 surety.
After considering both sides Magistrate Susan McGowan denied Le bail stating, there was a “huge possibility” he would fail to appear at future court dates if given bail.
“Police facts need to be taken at their highest, there is huge possibility he won’t appear,” she said.
Magistrate McGowan said while the police’s case “appeared to be in its infancy”, she didn’t think it was “particularly weak”.
Le will remain in custody bail refused and face Fairfield Local Court on Monday.
On the same night in a separate unrelated incident, a woman is accused of stabbing her sister in the neck during a “physical altercation”, involving alcohol.
Bidwill woman Aonk Awen 23, faced Parramatta Local Court on Saturday where she was refused bail over one count of reckless wounding.
Police prosecutor appearing in the matter of Awen, Sergeant Julian Oyta, said police had “grave concerns” for the safety of Awen’s sister, noting Awen had a history of violence and prior convictions.
When arguing for Awen to be at liberty, a Legal Aid solicitor said her client was a single mother.
In choosing to deny Awen bail, Magistrate McGowan described her alleged offending as “alarming”, and part of an “escalating history of violence”.
Awen will remain bail refused and return to Mt Druitt Local Court on Monday.
