A young Dubbo man is staring down the barrel of his first jail sentence after he bit a popular pub owner while drunk and threatened to sexually assault and stab two female police officers.
In a statement of agreed facts tendered in court, police said 20-year-old Tye Charters had been drinking at the South Dubbo Tavern on December 23 last year when staff asked him to leave because of his level of intoxication and unruly behaviour.
After Charters initially verbally abused staff and refused to leave, pub manager Lee Green intervened and Charters left the venue.
While outside near a bottle shop Charters started to urinate and when Mr Green asked him to leave Charters said “f*** off”, continued to relieve himself, yelled and swore at Mr Green.
When Charters finished urinating, police said he got in the back of a car parked at the pub.
Mr Gree approached the car and when he told Charters to leave, Charters got out and ran towards Mr Green.
The pair started to wrestle and in an attempt to stop Charters from assaulting him, police said in court documents that Mr Green put Charters in a headlock while Charters was on the ground.
After he was put in the headlock Charters gouged Mr Green’s left eye and nose.
Charters also bit Mr Green, under the left arm and chest, several times.
In court documents police said Charters was “trying to get the victim off him as he was having a panic attack and couldn’t breathe”.
After Charters managed to break free he ran off along Boundary Road and was later arrested and taken to Dubbo Police Station.
While in custody Charters made vile threats to two female police officers.
“You wait till they open the door, you’re gone,” he said.
“I’m gonna stab you and gonna f*** your mother
“I’ll find you and I’m gonna rape you both.”
When the case came before the Dubbo Local Court Charters pleaded guilty to assault, intimidate police officer and offensive behaviour in public place charges.
Magistrate Theresa Hamilton said she could not sentence Charters until Covid restrictions eased because he could possibly be sent to jail due to prior sentences he was still serving out in the community.
A sentencing assessment report was ordered and the case was adjourned to October 29.
