The tragic truth about road deaths in Australia

A Dubbo driver who reached 140km/h while being chased by police in a 50km/h zone after leaving a suspected drug house has been sentenced to a 22-month jail term.

In court documents, police said Timothy James Powell, 41, came to their attention on January 31 after he was seen leaving a “well known drug location” on Ulomogo Street at Brocklehurst near Dubbo.

Police said Powell was driving a Holden Commodore when he failed to stop at an intersection and accelerated harshly after noticing officers.

Shortly after unsuccessfully trying to catch up with Powell, police noticed him driving on Bourke Street in Dubbo.

Despite sirens blaring and lights flashing on a police car, Powell refused to stop and reached up to 140km/h in a 50km/h zone as he tried to get away.

Police said Powell managed to quickly drop a passenger off on Myall Street before he continued to drive and collided with the rear of an empty house on Callistemon Crescent, causing extensive damage.

After the crash, Powell fled on foot and was found hiding under a bush in the rear of a home on Longabardi Street.

In court documents, police said Powell was out on bail at the time of the pursuit, after he was charged with larceny four days before the pursuit.

On January 28, Powell walked into Westfund and stole four sets of sunglasses, including a pricey pair of Tommy Hilfiger glasses.

Police said Timothy James Powell had an extensive history.

After police arrested him for the theft, Powell was also found with an Apple Watch which he said he obtained from an unknown person in exchange for the drug ice.

When Powell appeared in Dubbo Local Court on Wednesday he was also sentenced for another offence which occurred in September last year.

Police said Powell picked up a wallet that fell out of a lawn mowing man’s pocket and used a card from it to pay for a taxi and items from the Myall Street shops.

Powell pleaded guilty to a string of offences including dishonestly obtain financial advantage by deception, larceny, property damage, driving despite never having held a licence and triggering a police pursuit.

Defence lawyer Molly Bland said Powell battled drug addiction and wanted to go to rehab.

The court heard Powell was sexually assaulted by a family member as a child and was entitled to a discounted sentence because of early guilty pleas.

Magistrate Gary Wilson said Powell had an extensive criminal record which did him no good.

“You’ve got numerous acts of fraud, property matters, et cetera,” he said.

“Pursuits are unfortunately all too common in this community. The risk they pose to other users of the roadway is extreme.

“Where you lost control was a built up area of this town.”

Powell was convicted and sentenced to 22 months in jail.

He will be eligible for parole in April 2022.
