Parkes man Derrick Hoe faces trial for rape

An excavation business owner from the state’s Central West who has been accused of rape gave his own account of what he says was a consensual encounter to police, a jury has now heard.

A man accused of sexually assaulting a woman at a NSW Central West home expressed his embarrassment at cheating on his wife in a police interview, a court has heard.

Derrick Hoe, 57, pleaded not guilty to sexual intercourse without consent following an incident involving a woman at a Parkes address in 2021.

Hoe, who runs an excavation business in Parkes, is now facing a jury trial at Orange District Court before Judge Graham Turnbull.

On Tuesday, the jury saw a video recording of Hoe’s initial interview with Parkes detectives in which he gave his account of the incident and denied it was non-consensual.

Hoe said he had visited the woman’s address before the night of the alleged incident to conduct some excavation and landscaping work in her backyard.

“I can’t believe this has happened … it’s embarrassing enough as it is,” Hoe said to a male and female Detective in an interview room at Parkes police station.

“Am I getting charged? My stupidity … I’ve never done this to my wife before.”

On Tuesday afternoon the female complainant – who cannot be legally identified – began giving evidence about her version of events in closed court, which cannot be reported on.

In the 2021 video, the female Detective put it to Hoe the woman alleged he pushed her down onto the bed and held her down by the throat.

“That did not happen,” Hoe responded.

The female Detective then put it to Hoe that he held her down and said “I want to fist you”.

“She opened the door, she said, ‘I want sex rough’,” Hoe responded. “I don’t do none of that, it’s normal sex with me.”

The female Detective asked Hoe what he had thought when she allegedly said that on his arrival.

“I was still in shock from her answering the door in the nude,” Hoe responded.

During the interview, Hoe said he digitally penetrated the woman, that they briefly had sex but did not finish because he had been drinking and could not maintain an erection, and they had used a sex toy together.

When asked if the woman had made complaints about pain or any indications of discomfort with the sexual activity, Hoe repeatedly denied that she had.

“(The woman) is alleging that you were quite rough when you were using your fingers and you kept saying you wanted to fist her,” the female Detective stated.

“No,” Hoe responded.

“Did she ever kick out towards you?” the female Detective stated.

“No, no … forcing myself onto a female, you don’t do that,” Hoe responded.

Hoe said the woman then called him a cab, told him he talked too much, and he left without any discussion of another subsequent meeting.

“It’s a one off, I can’t believe this has happened, it’s embarrassing enough as it is,” Hoe said to the detectives.

“I’ve got a beautiful wife and kids, as soon as she finds out …” he trailed off.

The trial continues on Wednesday.
