Noel Thomson: Man sentenced for sending voicemail and breaching court orders

A former western NSW man, who sent a detailed and threatening voicemail to his brother, has made a commitment to turn his life around. Read his sentence.

A western NSW man, who recent moved to Sydney for treatment, sent a detailed and threatening voicemail to his brother telling him “I will find you in the alley (and) stab you in the eye”.

Noel Thomson, 56, appeared in Dubbo Local Court on Thursday, for attempting to stalk or intimidate and intend fear of harm while breaching an established Community Corrections Order.

Mr Thomson has been charged on 34 occasions with NSW, including several domestic violence related offences and breaches.

He has a “dependence on alcohol” and has been in and out of rehabilitation centres for the past two decades.

The former Dunedoo man currently resides in Surry Hills, Sydney for his rehabilitation treatment.

Police facts tendered to the court revealed Mr Thomson sent a four-minute voice message to his brother – breaching his CCO.

“I’m gonna f**k you all over … I’m gonna f**king get you, it is a promise,” the offender said in the voice message in November 2022.

“I’m in Queensland at the moment, but I am gonna fix you up before the day I f**king die … I will find you in the alley, stab you in the eye one day.”

A few days after the incident, his brother reported the voice message to the police.

According to the facts, about 12.20pm, three days later, Mr Thomson attended Wooloomooloo Police Station for an unrelated matter to which police became aware that he was currently wanted for the breach.

“Police activated their body worn video cameras, introduced themselves and cautioned the accused,” the statement said.

“The accused made admissions to contacting his brother stating “that sounds like something I’d say”.

Mr Thomson was placed under arrest and conveyed to Kings Cross Police Station.

His solicitor Scott Affleck said his client has spent three months in residential rehabilitation and is currently undergoing further treatment.

Magistrate Gary Wilson praised the offender for proceeding with his treatments saying that he is on path to the right track.

“Keep up the good work,” Magistrate Wilson said.

Magistrate Wilson convicted and sentenced to a CCO for a period of 12 months to commence on March 23, 2023 and expiring on March 22, 2024.
