McDonald’s Dubbo brawl: Magali Peter convicted for affray

A woman is on the run in France after she and her friend attacked a McDonald’s customer in country NSW who told them to “go back to their own country”.

A McDonald’s customer who told two French women to “go back to their own country” was violently attacked by the pair in a brawl which had to be broken up by a delivery driver.

Magali Peter, 25, and Marei Moncassin, 24, were arguing with staff about their order at the McDonald’s Cobra Street store in Dubbo on November 15 last year when impatient customers started to make offensive remarks about their nationality.

In court documents police said when a man told the women to “go back to their own country” the pair followed him outside.

After the man noticed the women were following him he stuck his middle finger up at them and violence erupted.

Peter pushed the man in the chest and Moncassin ran at him from behind and used her left leg to kick him in the stomach.

After Moncassin punched and slapped the man, he retaliated and knocked her to the ground.

When Peter stepped in and hit the man over the head he tried to walk away, however Moncassin got up and kicked him.

After the man was punched and slapped again he grabbed hold of Moncassin and tried to restrain her on a nearby car.

While he tried to do that Peter grabbed hold of him and began to gouge at his face.

Police said Moncassin punched the man another 15 times and a McDonald’s delivery driver had to intervene to break up the brawl.

With Moncassin still irate, the man put her in a headlock and hit her four times before he got in his car and drove away.

Police were called by shocked onlookers and when they arrived 15 minutes after the brawl broke out Moncassin claimed the man stole her phone.

CCTV footage did not support her version of events and police said the man had acted in self defence.

Peter fronted Dubbo Local Court for sentencing after pleading guilty to one count of affray.

The court heard Moncassin had left Australia without fronting court.

A warrant was issued for her arrest on March 10 after she was convicted of affray in her absence.

Peter’s defence lawyer David Pheney told the court his client complained to McDonald’s staff because she had ordered $70 worth of food and only got a small amount.

“An Anglo Saxon woman uttered the words “f****** foreigners get back to France,” Mr Pheney said.

“My client is very embarrassed and remorseful for what she’s done.”

Mr Pheney said Peter had been provoked and the man had no lasting injuries.

The court heard Peter was an abattoir worker who deserved credit for fronting court and pleading guilty early.

“She’s been at Fletchers for the past 18 months, she works up to 75 hours a week,” Mr Pheney said.

“She has contributed to this country, she’s come out, she’s worked, she’s paid her taxes.”

Magistrate Gary Wilson said there was no need for Peter to behave the way she did.

“It was at McDonald’s there were lots of children around,” he said.

Peter was convicted and fined $1000.

Moncassin remains on the run.
