According to court documents, the 46-year-old former NSW Police dog handler attended the funeral of Wellington police Sergeant Brad Edwards on June 18 and afterwards he joined other cops at the Commercial Hotel.

Assistant Commissioner Peter McKenna, who was then the Orana Mid-Western Police District Commander, arrived at the pub about 10pm and was confronted by Cobby who asked if he attended the funeral.

“No mate, I didn’t know Brad, I never met him and never worked with him,” Mr McKenna said.

Cobby responded, saying “that’s pretty piss weak don’t you think”.

Court documents state Cobby’s demeanour changed and he became aggressive and confrontational, appearing heavily intoxicated with bloodshot eyes and slurred speech.

“A bloke works for your command for 30 years and you can’t even go to his funeral,” Cobby told Mr McKenna.

Mr McKenna hit back and said “he didn’t work for me mate, what would you have me do, go to every ex-cop’s funeral whom I haven’t met across the state”.

Cobby said “yes” and Mr McKenna advised that he “wake up” to himself and “go away”.

As Mr McKenna turned away, Cobby said “you’re weak as piss c***”.

“Les, just f*** off and leave me alone,” Mr McKenna said in response.

With a bottle of Bilpin cider in his hand, Cobby moved his head towards Mr McKenna and stopped short of headbutting him, court documents state.

Mr McKenna pushed Cobby away with one hand to create a distance between the pair and Cobby stumbled backwards.

CCTV from the pub showed Cobby quickly moved towards Mr McKenna and grabbed him by the throat.

Mr McKenna was struck with the cider bottle on the forehead between the eyes and he landed on the ground with Cobby on top of him.

After he was arrested, Cobby told police “you know the bloke you work with is a f****** c***head”.

Mr McKenna, who now serves as Northern Region Commander in Newcastle, was admitted to hospital and placed under general anaesthetic so his wound could be cleaned and closed.

He needed 10 stitches and will have a “significant scar” in the middle of his forehead, court documents state.

In Dubbo Local Court on Thursday, defence lawyer Jai Silkman said the case needed to be adjourned so he could arrange a psychological report.

Magistrate Gary Wilson also requested a sentencing assessment report.

Cobby is due to be sentenced on February 24.
