A Dubbo woman who crashed her car after she paid a secret visit to a poker machine lounge has been spared a conviction for assaulting a good samaritan who tried to help her.

Kylie Ford, 45, had been drinking alcohol at her home on August 8 before she got behind the wheel and drove to the Pastoral Hotel to have “a press”, defence lawyer Matthew Quill told Dubbo Local Court.

After Ford left the pub, she entered a roundabout at the intersection of Talbragar and Brisbane Streets, where she collided with a gutter and small fence.

The front bumper of Ford’s car almost fell off and one of her tyres was fully deflated after the crash, court documents revealed.

As Ford sat in the car, a good Samaritan who had noticed she was driving on the wrong side of the road before the crash approached her and took the car keys out of the ignition.

Ford asked for the keys back and grabbed hold of the woman’s left hand and squeezed her wrist.

“Give me my f****** keys, I want to go home,” Ford told the good Samaritan.

“My husband can’t know I’ve been drink driving”.

After the bystander told Ford police were on their way she fled the scene and was later found at the Dubbo Visitor Information Centre carpark.

“I had to drive home to get my kids,” Ford told police.

A breath test returned a blood alcohol reading of 0.149 and Ford pleaded guilty to mid-range drink driving and common assault in court.

Mr Quill said Ford told the court Ford had a “reasonably good traffic record” despite one prior offence of driving under the influence.

“Her intention was to go to the Pastoral Hotel to play poker machines,” Mr Quill said.

“She panicked about getting back to her house … her main concern was having to explain to her husband that she’d been at the Pastoral playing poker machines when they’d agreed it was a waste of money.

“He’s a very supportive husband, he works two jobs to keep them going.”

Magistrate Philip Stewart accepted the assault was “out of character” and he said because Ford had no criminal record, he would not issue a conviction.

Ford was convicted of mid-range drink driving, disqualified from driving for three months, fined $900 and placed on an alcohol interlock program for 12 months.
