A Dubbo man who didn’t learn his lesson has returned to court, pleading guilty to his second mid-range PCA charge within four months.

Kane Brett Keniry, 20 appeared in Dubbo Local Court, representing himself on Wednesday following his arrest in May after returning a positive result during a roadside breath test.

According to documents tendered in court, Keniry was driving his white Nissan Patrol travelling east along Thompson street in Dubbo when he was pulled over by police at around 2.15am on Sunday, May 15.

He was conveyed to Dubbo Police Station for further testing, which included a breath analysis of 0.120 and his licence was suspended on the spot.

Keniry said to police he “had about 10 beers throughout the night”, adding that he had just broken up with his girlfriend and was attempting to drive home.

“You’re in a bit of strife,” Magistrate Gary Wilson told Keniry.

Having discussed his recent offences, Keniry accepted that “unfortunately I didn’t learn anything” from the first matter.

Magistrate Wilson told the court that the 20-year-old was currently serving an 18-month good behaviour bond for the first offence.

“This time we’ve got it at a higher range than the previous one,” Magistrate Wilson continued.

“Do you know what the penalty is for the second one … you (do) know it carries 12 months imprisonment.”

While Magistrate Wilson noted that Keniry had just broken up with his girlfriend, he said it was no excuse to get behind the steering wheel.

“You’re going to be re-sentenced for that for your reoffending,” Magistrate Wilson said.

The matter was adjourned until August 2 with Magistrate Wilson requesting a sentencing assessment report with Keniry to report to Dubbo Community Corrections by Friday afternoon.
